As a result, the TSA has now updated its “What Can I Bring” page to indicate that medical marijuana, as well as CBD products that contain .3% or less THC, can now be either checked or carried on. This is, of course, provided that other rules are followed. For example, the item cannot contain more than the standard 100ml liquid limit for a carry-on item. According to the TSA, this change was prompted by the recently FDA-approved drug, Epidiolex, which contains CBD oil and which is used to treat seizures in children with epilepsy – though it is certainly good news for all who use CBD.

Having said this, however, it is still worth noting that those who wish to bring CBD products on their flights should be quite certain about where their CBD products come from and what they contain. While hemp-derived CBD products containing less than .3% THC are federally legal, any CBD products that are derived from marijuana or that contain more than .3% THC are not. As a result, it is extremely important to be certain about your CBD products and to know whether they comply with these guidelines.

Certainly, to the naked eye, it is virtually impossible for airport officials to determine whether a CBD product was derived from hemp or marijuana. If that product is tested, however, and it is shown to be positive for higher than the federally-legal limit of THC, those found in possession could be arrested. Needless to say, this is something you want to avoid while flying and in general.
